Joe will discuss common beneficiary errors at inception, problems that develop later as well as recent court cases and their outcomes.
Jon will address the varying definitions of Per Stirpes used by different financial institutions on their beneficiary designation forms vs. MN state law (a derivation of representation) and how it can be an important nuance in certain client cases. Jon came across this issue with a change in the beneficiary form used by Schwab and we had to evaluate using Per Stirpes or not utilizing it.
